These Terms & Conditions (“Terms”) govern the use of the Studiohersby website and any purchase made through it. By accessing the website or placing an order, you agree to be bound by these Terms. If you do not accept the Terms, you should refrain from using the website. Studiohersby reserves the right to update or amend these Terms at any time. Any changes take effect upon publication on the website. We encourage clients to review the Terms regularly. 

Use of Website

All content displayed on this website, including but not limited to images, photographs, text, graphics, logos, and design elements, is the property of Studiohersby or its partners and is protected by applicable intellectual property laws.

The content may be viewed, downloaded, or printed for personal, non-commercial use only, provided that all copyright and proprietary notices remain intact. Any reproduction, modification, distribution, or commercial use without prior written consent from Studiohersby is strictly prohibited.

Pricing, VAT and Customs

All prices are stated in EUR and include Danish VAT at the applicable rate, unless otherwise stated.

For orders shipped outside the European Union, Danish VAT will be deducted at checkout. Clients outside the EU are solely responsible for any customs duties, import taxes, local VAT, or additional charges imposed by the destination country. These costs are not included in the purchase price or shipping fee and must be paid directly by the client to the relevant authorities.

Studiohersby has no control over such charges and cannot estimate their amount or be held responsible for delays caused by customs clearance.

Orders and Contract Formation

Placing an order on the website constitutes an offer to purchase. After submitting an order, you will receive an email acknowledging receipt. This acknowledgement does not constitute acceptance of the order.

A binding agreement is formed only once Studiohersby confirms that the order has been dispatched or production has commenced. Studiohersby reserves the right to refuse or cancel any order at its discretion, including in cases of payment authorization failure, pricing inaccuracies, or inability to fulfill the order.

Made-to-Order and Final Sale

Studiohersby operates primarily on a made-to-order basis. Jewelry is produced individually after an order has been placed and accepted.

 Due to the nature of made-to-order production, orders cannot be cancelled, returned, or refunded once production has commenced. This policy is in accordance with Article 16(c) of the EU Consumer Contracts Directive, which excludes the right of withdrawal for goods made to the consumer’s specifications or clearly personalized.

Clients are strongly encouraged to verify sizing, specifications, and preferences prior to placing an order.

Private Viewings and In-Person Purchases

Studiohersby offers select clients the opportunity to view jewelry through scheduled studio appointments, private consultations, or curated pop-up events attended knowingly by the client.

Purchases completed following such in-person viewings are considered on-premises transactions. As the jewelry has been personally inspected, tried on, and approved at the time of purchase, these sales are regarded as final sale and are not eligible for return or exchange.

This does not affect the client’s statutory rights in relation to defects under applicable Danish consumer law.

Payment

Payment may be made using the payment methods presented at checkout. Payment is charged once the order is accepted and production is initiated or the item is reserved.

All transactions are processed through secure, encrypted payment gateways. While Studiohersby takes reasonable measures to protect customer data, we cannot be held liable for unauthorized access beyond our control.

Production, Shipping and Delivery

All Studiohersby pieces are handcrafted. Estimated production time is approximately 6-8 weeks unless otherwise stated.

Studiohersby ships worldwide using professional, fully insured carriers. Shipping costs are calculated at checkout or communicated upon request. All shipments require a signature upon delivery.

For international shipments, the client is solely responsible for any customs duties, import taxes, local VAT, or additional charges imposed by the destination country. Studiohersby is not responsible for delays caused by customs procedures.

Risk of loss transfers to the client upon delivery.

Defects and Complaints

In accordance with Danish consumer law, clients have a 24-month right to file a complaint regarding defects present at the time of delivery.

This right does not cover damage caused by normal wear, accidents, improper use, or external impact. Complaints must be submitted in writing to info@studiohersby.com within a reasonable time after the defect is discovered. Complaints made within two months are always considered timely.

Liability

Studiohersby’s liability is limited to the purchase price of the product. We are not liable for indirect or consequential losses.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any matter that cannot legally be excluded.

Force Majeure

Studiohersby shall not be liable for failure or delay in performance caused by events beyond reasonable control, including but not limited to natural disasters, strikes, pandemics, transport disruptions, or governmental actions.

Governing Law and Jurisdiction

All contracts are governed by Danish law. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Denmark.
